This and subsequent requests have yet to be fulfilled by FAU administrators. FAU President Frank Brogan has expressed his commitment to being honest and forthright about the reorganization of the university that has resulted in the termination of five tenured faculty. UFF-FAU thought it would take Brogan to task on htis commitment. On May 26 Associate Provost Diane Alperin signed a certified mail document acknowledging receipt of an internal records request sent by UFF-FAU President James Tracy. Under Florida law and the Collective Bargaining Agreement FAU is obligated to turn over any records requested within a reasonable amount of time. The time specified in the initial records request was ten business days from the receipt of the request, or June 10.
UFF-FAU officials find it especially curious that Brogan’s staff chose to hold off for several weeks on providing simple cost estimates for the records requests concerning the layoff of the tenured faculty members (UFF did not receive such cost estimates via email until July 8), and elected to tack on additional charges in the process. A similar public records request to FIU filed at the same time has already been fulfilled, and with no excessive administrative fees. What is the FAU administration attempting to hide?
After an additional request for why the records request has taken so long UFF-FAU President James Tracy was furnished with another vague explanation by one of Brogan’s assistants. We will continue to update you on what future measures UFF intends to take to make the administration comply with the law.
